Legally establish your tax home in a low-tax or zero-tax jurisdiction. Reduce your global tax burden while staying fully compliant with international law.
Anchor your company operations in a jurisdiction with favorable corporate laws, banking access, and international trade agreements.
Relocate your family permanently or obtain a second residency for travel freedom, lifestyle upgrades, and long-term security.
Know Your Indian Residential Status
Before you plan a residency abroad, you first need to know where you stand at home. Your residential status decides how much of your income India can tax — here's how it's worked out.
You're treated as a Resident if you meet at least one of these two conditions for the financial year (1 April – 31 March). Meet neither, and you're an NRI.
You stayed in India for 182 days or more during the current financial year.
You stayed 60 days or more this year, and 365 days or more across the preceding 4 years combined.
The 60-day threshold is relaxed to 180 days if you're an Indian citizen or Person of Indian Origin (PIO) who left India for employment abroad, left as a crew member on an Indian ship, or is visiting India with total Indian income under ₹15 Lakh. If your Indian income exceeds ₹15 Lakh, the relaxed threshold is 120 days instead of 60.
Qualified as a Resident in Step 1? Next, check both tests below. Pass both and you're ROR. Fail even one, and you're RNOR.
Resident in India in 2 of the last 10 financial years.
Physically present in India for 730 days or more across the last 7 financial years.
| Status | Basic Condition (Step 1) | Additional Test (Step 2) | What Gets Taxed in India |
|---|---|---|---|
| ROR | Meets Condition A or B | Passes both Test 1 and Test 2 | Global Income |
| RNOR | Meets Condition A or B | Fails Test 1 or Test 2 (or both) | Indian Income Only |
| NRI | Fails both Condition A and B | Not applicable | Indian Income Only |
This is a simplified guide to Section 6 of the Income Tax Act, 1961, meant to help you understand roughly where you stand. Your actual status can depend on additional facts specific to your situation — talk to our advisors before filing or making a move.
